Will Jerry Brown sign the California Dream Act’s AB 131?

California Gov. Jerry Brown has just four days left to sign or veto a bill known as AB 131, part of what’s called the California Dream Act, before a bill-signing deadline.

Brown has indicated his support in the past for the measure, which would allow undocumented students access to publicly-funded financial aid for college. But with little time left to go – and a history of similar bills being vetoed by former governor Arnold Schwarzenegger – the students who would benefit from AB 131 and immigrant advocates are increasing the pressure.

In Los Angeles, student activists organized a small demonstration downtown this morning to deliver petitions to Brown’s local office. Other AB 131 supporters have been circulating petitions online and urging calls to the governor.

No word yet from Brown’s office today on the likelihood that he’ll decide on the bill before Friday, but a spokesman for AB 131 sponsor Gil Cedillo, a Democratic state assembly member from Los Angeles, said the governor has until Sunday.

“The deadline is the 9th, so even if it is a weekend, that is the last day he can sign or veto bills,” wrote Conrado Terrazas, Cedillo’s spokesman, in an email.

The stakes are high and the bill is especially contentious, with supporters and opponents divided along more than party lines.

AB 131′s companion bill AB 130, the first of the two bills comprising the California Dream Act, was signed into law by Brown in July. Also sponsored by Cedillo, that measure allowed undocumented college students access to privately-funded scholarships and grants that were not available to them before. While there was opposition to that bill, it was mild by comparison, as were the related costs.

AB 131, on the other hand, would allow undocumented students who meet state residency requirements to access the same state-funded tuition aid programs available to U.S. citizens and legal residents. The measure has come far enough in a tough state economic climate. Implementing AB 131 could cost anywhere between $22 million and $42 million, according to Cedillo’s office, although roughly $13 million of that would come from money that is already set aside for low-income students whose grades qualify them for CalGrants.

Opponents of AB 131 say they don’t wish to spend state funds on educating undocumented students, especially if their immigration status prevents them from fully using their degrees after graduation. That, and that there’s not enough money to go around given the state’s financial woes.

Unlike the federal Development, Relief and Education of Minors (DREAM) Act, neither of the California bills proposes granting legal status to students. By law, undocumented immigrants in California do qualify for in-state tuition if they meet residency requirements, but they are presently barred from receiving public tuition aid, as other students can. As an alternative, many work multiple jobs while they study, spreading out their education over several years.

Brown has until Sunday to sign or veto a long list of recently passed bills. Among them is another controversial bill involving college students, SB 185, which would allow the consideration of race, gender, ethnicity, and national origin in undergraduate and graduate admissions,

    My Grandfather immigrated from Cuba in the 1930′s. He joined the military, served for six years, and earned the right to become a citizen. In this process, he never once sought money from the State. Immigrants of today are not the same as immigrants from ‘yester-year’.

    Just to set the record straight, this is not about loans.  Illegal Alien Students are not eligible for loans.  AB 131 (Development, Relief, and Education for Alien
    Minors and its contents at:  http://www.aroundthecapitol.com/Bills/AB_131/20112012/ will give FREE State, Local, and Federal monies for books, living expense, etc., EOPS funds, fee (tuition) waivers, and other Board of Governors discretionary decisions.  It does not make them eligible to be legally employed, nor provide a path to citizenship.  It would give them free money for a higher education with no ROI (return of investment) and add to our bankrupt State’s debt ($38 Million) while displacing and “pricing out” those Legal Students (Californian Legal Residents and Legal Immigrants) through reverse economic discrimination.  Also, for the four year schools, out-of-state and Foreign Nationals are being recruited because they can pay nearly double the in-state tuition, to line the coffers of the de-funded system.

    I don’t know about you but I currently have student loans totally in excess of $70,000. (a great deal more than “a few extra dollars”) I was going to school for a Special Education credential. With the current State budget cuts, I can not get a job where I can use my hard earned education. My children (born and raised in California) have to pay for their own college educations as did I.
    It has been my experience that, if a person desires the degrees and benefits of a higher than 12th grade education, NOTHING will stand in their way.
    We as citizens hand everyone a free and appropriate public education until adulthood, after that it is a personal decision.
    When making personal decisions, the responsibility for those decisions should be on the person making them.

     We can’t blame on the kids for being brought here illegally by their parents so we provide them free K-12.  They now grow up and suppose to earn money to pay for their own “higher education” as all our legal kids do.  Why should we continue paying for their free “higher education” while our legal kids are struggling to pay for themselves?  It’s like the children of illegals are more beneficial than being born to legal residents/citizens.

First, the money from financial aid goes to every US citizen who qualifies for it, then the money that is left can cover for illegals. Every year there is always millions in financial aid left. That fact that your special education credential was not covered by financial aid has nothing to due with immigrants. Like you said that was your personal decision for choosing that career.
    If your children are paying for their own school then you are probably making so much money to not qualify for financial aid. I make roughly around 60k a year, and my daughter is still eligible for financial aid.

    The eras don’t compare. During the great depression, there was no government assistance until Roosevelt signed major construction jobs bills and other progressive reform bills. Even then, there was no guarantee of a job, so what did men do instead? that’s right, join the military. I almost guarantee you that your grandfather took advantage of the G.I. bill that was passed shortly before the war was over in one way or another.

    What decisions your grandfather made, he did so as an adult. AB 131 is for kids that were brought here illegally as children. Assuming that you still have a connection with your Hispanic heritage, how can you criticize these kids for asking for an opportunity to earn the right to an education? Forget the legal vs illegal argument, my grandfather migrated back and forth illegally between Mexico and the U.S. without a problem until he decided to stop by the immigration office and pick up his green card before becoming a U.S. citizen. 

    Times have changed, the rules that once applied have changed. This has always been a country of immigrants and for anyone to claim that only they have the right to live here is ridiculous. True, everyone should follow the law as far as immigrating legally, but when necessity rules out other options, you can’t blame someone for doing what’s best for their family.

    A State Senate report estimated the annual cost of the bill to be
    around $40 million. The fiscal impact for the 2013-14 school year would
    be $13 million in Cal Grants, $7.5 to $15 million in fee waivers, and
    $11.4
    to $12.2 million in institutional aid.  If this is signed, the costs
    for each ensuing year will go up being that this population affected are
    12-35 years old.  Wouldn’t you think that it would also increase the
    rate of illegal immigration thinking that a similar Bill and a possible
    “blanket amnesty” via an (improbable in the near future) Federal DREAM
    Act?

    SB 185 is just another  version of affirmative action.  We all know how well THAT worked and the abuses it entailed.

     I am an undocumented student i have been living in the us since the age of two my dad my mom are both undoucemnted and the have never broken the law never asked for welfare. We aren’t stilling money from american citizen that pay taxes because we also pay taxes. My parents are giving and IRS to pay taxes but aren’t giving a working visa. At the age of ten the irs gave me and my sister and IRS number for us too pay taxes too when ever we stared working but nothing to our benefit.My dad gets taken away the same amount of money as any other tax payer would, but he gets much less back than an american citizen tax payer would. 

    So who are we stealing from?

    Read it yourself.  Don’t take my word or the word of someone that is so bold as to use the name, “Anon.”  If all they were getting were the “leftovers” there wouldn’t be this big push to get it passed.  It wouldn’t cost $38 Million in the first year alone and probably more for each ensuing year.  The strategy for AB 131 Students will be:  to go to Community Colleges, where they will get tuition waivers and EOPS, get a two year degree, get free money for transfer Grant, then receive further free aid to get a four year degree and possibly further.  All for no economic return, no contribution to our society, no guarantee of Citizenship with their ability to take their free degrees and leave anytime.  All this while displacing and “pricing out” Legal Californian Residents, US Citizens, and Legal Immigrants.  Read it and weep.

    Under the Mexican law, illegal immigration is a felony, punishable by up

    I bet that “living illegally” in Mexico for years grants you no extra rights or privileges, whether you were brought as a child or not. If you are an actual political refugee then start working on changing regimes in MEXICO, where you were born, or go through immigration like my ancestors did, otherwise you’re no different from anyone who illegally occupies property that isn’t theirs.
