Gov. Jerry Brown signs AB 131, second part of California Dream Act

It came down almost to the wire, but California Gov. Jerry Brown has signed legislation that will allow undocumented college students in the state to obtain the same kind of publicly-funded financial aid for tuition now available to U.S. citizens and legal residents.

Late this morning, Brown signed a bill known as AB 131, the second of two bills referred to as the California Dream Act. The signing deadline was tomorrow. The Sacramento Bee published part of a statement from Brown:

“Going to college is a dream that promises intellectual excitement and creative thinking. The Dream Act benefits us all by giving top students a chance to improve their lives and the lives of all of us,” Brown said in a prepared statement.

Both AB 131 and its companion bill, AB 130, were sponsored by Assembly member Gil Cedillo of Los Angeles, who has successfully shepherded similar measures through the legislature in the past, all met with vetoes. While Brown had expressed support for both measures, the time it took for him to sign AB 131, approved by state lawmakers at the end of August, had both supporters and opponents of the bill wondering if he’d decline to sign it.

Part of what made the bill so contentious is that unlike AB 130, which only entitles undocumented students to privately funded grants and scholarships, AB 130 requires the use of state funds. Cedillo’s office has estimated that implementing AB 131 could cost anywhere between $22 million and $42 million, although roughly $13 million of that would come from money that is already set aside for low-income students whose grades qualify them for CalGrants.

As controversial as AB 131 has been, it is not the first state measure allowing undocumented students access to publicly funded tuition aid. According to Cedillo’s spokesman Conrado Terrazas, New Mexico and Texas similarly allow public financial aid for undocumented students, and Illinois has legislation allowing them access to privately-funded tuition aid. Several states – including California – allow undocumented college students who meet state residency requirements to pay less costly in-state tuition rates.

A post earlier this week on whether Brown would sign AB 131 generated more than 70 comments on the Multi-American site, with readers getting into heated debates over the bill. “VETO!” one reader posted last night.

    At the cost of tax payers who are
    already bled dry from the outrageous taxes in this state.  But then, when you are “undocumented” (ILLEGAL) you don’t pay
    any taxes.    Oh yeah, maybe some sales tax here and there.
     But that adds up to peanuts and a cup of coffee when you compare it to
    what I pay in income tax every year.  Just another free ride for the non-contributes
    in this state.  

     

    What
    are you going to do with the degree that I paid for.  You still can’t get
    a job because it is ILLEGAL to hire “undocumented” workers.
     Unlike the un-skilled labor jobs which are plentiful for the
    “undocumented”, because of the IMMORAL people who hire the
    “undocumented”.  Yes! I said immoral, because breaking the law
    is immoral.

     

    Reputable
    companies will not hire the “undocumented” because it’s ILLEGAL and
    they will have to be responsible for their actions.  They get fined by the
    same government who just authorized this absurd law.  On top of fines from
    the Federal government.  

     

    There
    is a novel concept, “RESPONSIBILITY FOR ACTIONS”.  The
    government of this decaying state lost sight of that concept years ago.
     How is it that we Californians have the highest taxes of any state in the
    union, yet the state is flat broke, and has the lowest credit rating in the
    nation.  AB 131 the “Dream act” is an example of the poor fiscal
    responsibility that is characteristic of this states government.
     

     

    Let
    me back track a second because I just had an epiphany.  California
    fines the businesses that hire “undocumented” workers.
     That’s REVENUE for the state.  I get it.  Pay for the
    education of the “undocumented” with tax payers money, so they can get higher paying jobs
    with companies that are worth more money, then fine those companies
    for hiring the undocumented workers the were educated and provided for
    them. on the tax payers dime.  Genius!   WOW!

     

    So
    the “undocumented” are really just pawns of this crooked and criminal
    government that hides in the facade of humanity and equal rights for
    all.  In the end it’s all about money again. 

     It’s alright though
    I’ll soon be taking my tax dollars to a state where I will actually be
    represented. It’s not all a total loss either.  California is a good
    example of how not to run a state.  And the other states are watching.  Beloved
    President Obama would not even help this state when he was asked.  I won’t enjoy it but I will watch as
    California continues it descent.  The road to hell is full of good
    intentions, and in this state, hand outs are the religion
    and economics are a superstition.

    It’s actually law that 40% of the state budget gets spent on education.  It has been for a long time.  The state blindly throws money at the education system and we still have the worst one in the country.

You use an ITIN. Why would they pay if they don’t have to? Because they are trying to start a good record in the states in hopes one day they will be able to apply.

    I was also born in California and have lived here for 30 years and I’m disgusted.  How are they going to get out of poverty when they can’t legally work?  Are the undocumented just miraculously going to become legal citizens when they finish their degree?  NO! 

    Judgmental? maybe.  But ignorant? Definitely not.  Ignorant is a statement like “If jerry Brown passed it then their has to be a reason for it”  Not only did you use the wrong spelling for “there” but you have no idea why he passed this law.  I’ll tell you why.  To buy the votes or the poor and underprivileged, if he gives out money to them they re-elect him.   He and his government cronies do not care about you or anyone else.  They just want to pad their position of power over you me and everyone else.  Don’t think for a minute that these laws get passed because they actually help.  This one won’t.  We don’t have the money to fund it in the first place.  But we will put the state into deeper debt and fund it anyway.  And the what?  in 5 years we will have a costly population of educated job seekers who can not legally work.  How is that going to ascend them from the drouths of poverty?  Education or not the “undocumented’ cannot legally work.

    OK OK you are right.  In 2010 California raised 2.7 billion in taxes from households headed by an undocumented worker.  But California also spends 10.5 billion annually of education, health care and incarceration of of the illegal immigrant population.  Let us just do a little bit of simple math.  2.7 billion – 10.5 billion = – 7.8 billion.  Huh, I think the undocumented population is a little short of a bakers dozen on this one.  I wonder who is paying the missing 7.8 billion.  I’ll give you a few guesses.

    For some of the people that say undocumented students are taking advantage of the system and are getting a free ride to college. Are you kidding me? Undocumented have been going to college way before this Act was passed and they have become citizens to PAY taxes. To say that undocumented students are lazy and are just getting a free pass is ignorant. Most undocumented students are top of their class and are involve in their community in many ways. Things that documented students are just taking for granted. Also undocumented students are not getting a free ride, they still have to compete for cal grants with ALL students. Take into account that also this is only 1% of college students. You say we are getting a free ride but were just trying to better our lives and in return better the country that gave us so many  opportunities. I grew up in the United States all my life and iv’e seen thousands of documented students just taking for granted all the opportunities that are granted. I’m a freshman this year and i would have still gone to college even if this law did not pass. You want to know why? because i want to give back to my community, i want to be an advocate for education not just for IMMIGRANTS, but for all children who are taking their opportunities for granted. To tell me that i don’t deserve to strive for my goals is just ignorant when over 90% of college students are documented. If your kids can’t get into college maybe they should try harder. If  undocumented students have done this for years and according to most people they are ignorant,stupid, undeserving of educating themselves, then i see no problem for upstanding, smart, educated students to not get accepted to any college.

    You qualify for grants, loans, etc… There’s also unemployment and many other things…. Undocumented students do not have that advantage. Undocumented students bust their butt to get through college. Their financial aid is their parents who work hard and get paid minimum wage. You have no idea of what it is to be an undocumented American who has amazing goals and dreams and doesn’t have the same advantages… Yes I said undocumented Americans because undocumented students are really Americans who have lived in this country most of their lives but do not have a document that says they are citizens. It is really sad to see all this negative comments. I wish people could really see how amazing undocumented students really are, as well as the families they come from. This people are truly a contribution to this country.

    I agree with Think, education is always positive. I also want to ask everyone else who keeps calling each other ignorant and uneducated back and forth to stop. The problem is not within us, the problem is something bigger, and putting each other down is certainly the worst approach in resolving. I ask that everyone stops degrading each other, and instead work together to find the real problem. Just keep in mind that everyone is human and everyone deserves the opportunity to be educated on the world since media can’t do that.

    You all miss the overriding issue here.  It is not really about financial aid.  You are right, what this bill will cost is a drop in the bucket compared to the 10.5 billion illegal immigrants cost the state every year.  (refer to later post).  I conceded that in fact some illegal immigrants do pay taxes.  But if you again refer to a later post, the tax money collected from illegal immigrants doesn’t offset the cost.  This is simple economics.  Illegal immigration, voluntary or not is a drain on our economy, and we should not be fostering an environment that attracts more illegal immigration.  

    Since I’m so ignorant of everything, someone please enlighten me.  Why don’t illegal immigrants take the time and go through the process that LEGAL immigrants do?  It’s not some mythical fantasy.  Many people who chose to come to the U.S. do it the right way.  Is it impossible for a child who was brought here unknowingly and illegally to become a citizen?  Because the impression is that the illegal immigrant population is not seeking legal status.  And if the impression is indeed fact.  Why aren’t they?

    Illegal Immigration is not a victimless crime. The educational goals of legal citizens are being comprimised in order to serve the interests of illegal residents of California. It is an injustice that will continue to set back many innocent, struggling legal students in California by making it even harder to receive financial aid, as it makes available finite resources for anyone not legally a citizen to come in and grab for themselves.

    Join us in the fight against the Dream Act. Do not let our innocent students suffer the ultimate cost of illegal immigration. We cannot open up financial aid to whoever wants to walk in to the country and claim it.
     
    Every dollar then that goes to an illegal immigrant is taken from a legal citizen in need which is unfair.

    You are close, I don’t have any kids.  Can’t afford them right now.  But studying politics never interested.  I’m currently a medical student.  Patriot YES.  I actually earned my education with 10 years of service to this country as a Navy Rescue Swimmer,  I’ll continue to serve once I’m finished with school.  You can mock, but if it weren’t for patriots like me you would not have a haven to flock to.  Why don’t YOU earn an education and your citizenship at the same time.  I’ve served with lots of people who did just that.  They gave a lot and were rewarded for it.  I have the number of a few good recruiters if you would actually like to contribute something to the country that gives you so much.

    I just wonder if their parents have to suffer too much then why sneak in our border to get here illegally?  And since we have been generous enough to pay for their free K-12 since all illegals blamed their parents brought them here without the fault of their own.  And the kids now all grow up, they have to pay for their own higher education if they wish to achieve.  Just like what our kids are doing.  Why the hell our kids don’t qualify because we are US citizens and our tax dollars go to pay for the illegals?

    I’ll be soon moving out of this Illegal Immigrant Dream State and I’ll help this state to advertise the free education to the kids from other countries so they can come here and achieve their California Dream because our California Smart Governor is willing to support all of them.  Thank you so much Mr. Wise Gov.     I’m guessing you really don’t have an answer to the questions that you asked, let me help you out a little.

    “Why don’t illegal immigrants take the time and go through the process that LEGAL immigrants do?” The reason why these people leave their country and enter the United states illegally is because most of them do not have the means to feed their families properly any longer. Many can’t find jobs any more due to their old age (40+ is considered almost “too old” to work). These people will do anything to prevent their family to starve or become homeless.  ”Why don’t illegal immigrants take the time?” I find your question a little humorous because it shows how inconsiderate you are as a person. If illegal immigrants had the stable job, money, and other requirements to come to this country legally, then I can assure you that there would be no illegal immigrants in this country.  Let me say this again but in different words, illegal immigrants are humans who have families and need to eat. They do not have the time or money to come here legally. What would you do if you were faced with the same dilemma as an undocumented person?

Many people could be thousands compared to the millions here illegally, in this case many is such a small number. The people who come “the right way” have a stable financial situation back in their hometown. That’s why they’re able to come here legally. 

    “Why aren’t they seeking a legal status?”There are extensive requirements and steps that an illegal immigrant must follow in order to try to become a citizen. There are multiple penalties against immigrants that stops them from trying, one of them being entering the country illegally. There are also various obstacles that won’t allow them to work out their paper work such as, not enough income, fear of deportation, lack of information and ignorance (not knowing the exact procedures and assuming that it’s not possible to change their status). The desire to become a citizen lives in the hearts of every immigrant; one example was the walks for the amnesty a few years back. 

    I read through you posts and found various assumptions and “ignorant” remarks. When I say ignorant, I’m meaning “unknowing”. You may have a lot of understanding of what’s happening in the economy but you have little to no information about the lives and reasons of illegal immigrants. I’m not saying that ALL immigrants are good; nor I’m asking you to pity them. I want you to understand the reasons behind their journey to this country and their hopes to have a better life compared to what they used to have.

    I agree to all of the above and I also want to add to it.  Undocumented people do pay taxes and if there was some type of law that would give all these students legal residency, I am more than sure we can pay the rest of the taxes that you guys say we are short on.

    Children are innocent of coming to this country undocumented.

    There’s also people who want to fix their legal status, but the laws aren’t much help. If you are married to a US citizens or you have children born as US citizens.. I think people should be entitled to changing their legal status. Unfortunately, the fact of entering the country illegally compared to those who enter with a visa, is screwed up. The laws do not allow these people to seek residency. That tells you the laws aren’t fair and they need to be changed.  It doesn’t matter if you were brought young illegally (7yrs old or younger) they don’t care. They still consider you as not entering the country the right way. Even if you were brought young and then married a US citizen, you still cannot fix your status. Regardless if you have a clean record ( a clean background) and regardless if you are a hard working student who is trying to obtain a career and later on want to contribute to the country.

    I hate the fact that many people generalize all people, for what some do. Many people say undocumented people are criminals and they come to take advantage of all the money and health care programs they have. First of all, that’s not true. I am not saying all undocumented people are great people, but the majority are. Just the way I notice every time I go out is most of the time legal residents and citizens the ones getting in trouble w/ the police. Undocumented people don’t really get much help. Most people do not qualify for health care or any type of insurance. The ones getting health care are the babies who are born as US. citizens.

    I want to finish up saying. Most immigrants are not here because they love to be here, it’s because they have to. Their only crime is to try to give a better life to they children and to themselves. If they were financially stabled in their countries, they wouldn’t be here.  That’s because their country’s economy is a disaster.

    Case not closed.  That’s the beauty of this country.  It can be appealed in court and most likely will.  The law does not take effect until January 2013.  Since it subverts federal law, I don’t think it will stand up in the higher courts.  That is the system of checks and balances.  Legislators are not all powerful.  Many California laws end up this way.  Just a waist of time money and effort.

    The issue at hand has nothing to do with education.  It is the fact that we, the legal citizenry, are now supporting the illegal population in yet another way.  There are many who are denied Calgrant money based on their income.  Yet the process seems arbitrary at best ….
    Now that “pool” of money has is further strained by offering up public money to illegal residents.  That means the bar will be increased even more …..

    This is not a win/win scenario.  This is a situation where a group of people who are breaking laws, and now taking even more.  And at the expense of legal residents. 

    If illegals paid an equal share of taxes – then this would be a non-issue.

    Illegal aliens are welcome to an education.  Just pay for it yourself.

    I love the fact that you are going to college and trying for a better life.  

    But you need to finance it, you need to pay for it. 

    Public money in which all put in a relatively equal share of the money, should not be offered to those who don’t (can’t) pay equally into it.

    Illegals pay sales tax and fees.  But they can’t pay most of the other taxes that build the pool of money Sacramento operates on.

    Please – go to college.  Support the community you live in.  And help us figure out a solution to this problem of illegal immigration … but don’t make us pay for it.  We have our own children to support.

    The math is a bit off. A State Senate report estimated the annual cost
    of the bill to be around $40 million. The fiscal impact for the 2013-14

    I thought I would get an answer like that.We can’t let every person who needs a job in, just because they need a job.  No country does that.  There are plenty of citizens here who need jobs.  Sure, feed me the line of crap about how illegal immigrants take the jobs no one wants.  If they were not here to take that job, rest assured it would be taken by a citizen.  An ilegal immigrant solicites his labor for less wages then what the law mandates.  And shame on the people who hire them.  They should be dealt the full extent of the law.  Both of them.  if 15 million illegal immigrants were not putting such a drain on our social systems, then it would ease the tax burden on legal citizens.  It would allow employers to pay the legally mandated minimum wage to citizens who would be able to take the jobs filled by illegal immigrants.  The laws of supply and demand are simple, if 15 million illegal immigrants were not here occupying 10 million jobs, 10 million jobs would be supplied, and those jobs would be filled by American citizens.  The next question is why isn’t the country of origin doing anything about it’s obvious problems.  Weather it be Mexico or China.  Why do illegal immigrants feel it is perfectly OK to break the laws of this country.  Because weather you like hearing it or not.  Illegal immigration is a crime.  You can call me all you like, ignorant, cruel, inhuman whatever.  But the bottom line is that I’m an American and my first duty is to Americans.  I don’t have it in my continence to be sympathetic to another nations problems.  Fix them yourself and quit adding to my nations problems.

    You also do understand that not all illegal immigrants will get this financial aid since there different types of Cal Grants. There is a reason this kids are going to college. To become US citizens in the future and not just because they want to get a degree that would be worthless without citizenship. Let’s say an undocumented students does get financial aid trough cal grants. That would be around 17,000 for 4 years. After he gets his degree he is required by law to apply for citizenship, why wouldn’t he if he has a degree, because he sign an affidavit under ab-540 act. After those 4 years he has to pay taxes for the rest of his life if he becomes a US citizen. Isn’t that better in the long term for everyone and not just him. Also i have no problem if this law is ratified to include that those Cal grants be made into loans, to be payed after the student has become a citizen and has the means to a quire a good job after he has completed his college education. If the money is the problem for many people, then i see no problem in going to Sacramento and making your voices heard. If a provision like this can be made into this law then everyone wins and you no longer have to pay taxes for “nothing” because you can change it. Just make your voices heard and go down to Sacramento, just like all those in support of the dream act did.

    I like what you have to say and I agree with you (not surprised). I also see the point of view of all the rest of you and understand your plight and your desire for an education and an improvement of your life.  After all, isn’t that why the majority of all immigrants come to this country, for a better life?  Yes it may be difficult to get the path to legal residency established but don’t you think that it’s worth it?  Many of  you say that you want to become legal.  Isn’t the trouble worth it then and give back to the country in which you say has help you so much?   My parents emigrated from Cuba over 45 years ago to escape tyranny and had to wait three long years to get the permission to leave their homeland.  We came to the US as political refugees and since then, my parents have worked hard to make a decent living, learned the English language, raised my sister and I who graduated college and we’ve raised or own children and have experienced first hand the difficulty of getting funding for an education.  Especially now with such deep budget cuts in our colleges and universities.  Why would it be fair for someone who is not legally here, receive what my children, children of LEGAL immigrants and hard working parents,  aren’t qualified for? Why do so many of you children of illegal immigrants feel you are entitled to a free college education or take legal citizen’s children’s seats in our college and universities?  I’m not saying you don’t deserve to go to college, I’m just saying you should pay for it and not be given preferential treatment because your parents broke the law!  My husband and I are law abiding, hard working individuals trying to provide an education for our children.  Yet since we fall into the middle income trap of not being dirt poor or wealthy, we will not qualify for any grants, and student loans will most likely be our children’s only option for a college education.  Why would your parent’s breaking the law, give you the right to take money away from a deserving and equally qualified LEGAL citizen?  Yes, education is extremely important for the improvement of your lives, no doubt.   I just don’t want to be forced to pay for it.

    So where will the money needed to fund this program?  As we already know funding for college is at all time low while fees are at all time high.  In order for a child born not of this country will take monies from a child born in the state is a LEGAL resident of the this state.  What about their dreams of going to college and getting a better education?  You can only steal from Peter to for Paul for so long and once Peter is broke how will those under Paul survive?

    You should have read a little further down before resorting to name calling.  

     In 2010 California raised 2.7 billion in taxes from households headed by an undocumented worker.  But California also spends 10.5 billion annually of education, health care and incarceration of of the illegal immigrant population.  Let us just do a little bit of simple math.  2.7 billion – 10.5 billion = – 7.8 billion.  Leaving legal citizen tax payers to cover the 7.8 billion dollar deficit.  

    I agreed Illegal immigrants do pay SOME taxes,  but obviously with numbers like the ones above, many are not.  And you bring up a few good points.  TAX deductions, it’s safe to say that the illegal immigrant population are some of the lowest wage earners, that means coupled with deductions the taxes actually collected are minuscule.  But we already knew that, just site the information above.  I’ve already said this plenty of times…. There is a huge deficit between the cost of illegal immigration and the taxes paid by some illegal immigrants.  

    And the PROGRAM should be a balanced budget and a lighter tax load for citizens.  That would be a little easier if we didn’t have to pay for non citizens who take more then they contribute.  You can argue all you want, but those numbers up there are facts.     

    It’s more than reasonable for the legal citizen tax payers to be frustrated with a government that does not put them first.  As stated by others, there are a lot of families that can’t afford to send their children to school, but don’t qualify for financial aid.  Their needs should be addressed before any non citizens.

Now if the government decides to give us that citizenship to pay for taxes or any kind of other fee that we must pay for citizenship it’s up to the government. Also, i am educating myself as you so kindly stated because i want to make a difference in this country, where thousands of students are left behind because of their economic status.  Restating what i said already, you should march down to Sacramento to make your voice heard if you have a problem with this law. That is the beauty of this country. I’m willing to pay my way trough college with scholarships that kind people, who do believe everyone deserves a chance, have donated.

I migrated to this country – just like some members of your family tree once did (you can’t argue against that, unless you are of Native American decent, whom even they were at one point immigrants to this land)- along with my mother and father, attended school, attained my citizenship and now a college student/part-time employee. I feel blessed to have had such opportunities  I really do. And if there is any way I can help person in need, immigrant or not I have the heart for that too.     California has just announced a budget cut of $1Billion, including $200M in UC and CSU education budgets.

    Our liberal legislators (all Democrats) and Governor Brown just voted for this $60-$80 MILLION tax giveaway to illegal alien college students!

    Time for a recall of all liberal Democrats in Sacramento (zero Republicans voted for the Dream Act)?

    I am proud to say I am American! I am half Caucasian and Half Peruvian. My mother’s side came here from Peru and they did it the right way. Getting a visa and then applying for citizenship. My grandmother studied hard for the test and she passed. Being grateful to be in a country with many opportunities. I admire my grandmother so much, she taught me so many things in life and most importantly she taught me to work hard in life. My uncle her youngest son came here at the age of 12, not knowing any english but studied hard to excel in school. By high school he was in all honors and AP classes but at the time wasn’t a citizen just yet. He’s dream was to go to college and get the best education he can to make his mother proud. Getting excepted to UCLA, he had no idea how he was going to pay for his education. My grandmother told him to follow his dreams and she will take care of it all. Working two jobs and putting her illegal son through college, he ended up getting his Masters in Science. My grandmother worked hard and not once asked for government help. My uncle eventually got citizenship through her. She’s an amazing individual who never asks for help. Her reason for it, she says “This is not my country, I was not born here. I came here for opportunities but not to just expect the government to pay for my life. I came here to work hard and get what I need by doing things myself. I’m not going to be a selfish person and expect money from a government from a country that I wasn’t born in. The money belongs to Americans. The generations of the people who actually fought in the wars and fought for freedom. Who fought for social security and for education. She said she would rather die then take money that doesn’t belong to her. If I can put my son through college with cleaning hotel rooms by myself, then others can as well.” She is who I look up to every day of my life. My reason for the choices I make in life. My mother was the same way. Unfortunately, had horrible luck when it came to men and got nothing but children from them. Six children and has never asked for child support or government help. Worked 3 jobs to support her children. she says ” I made the choice to have my kids, and the government is not supporting them I am” I love my family and what they stand for! Work hard and you can make it in life! Do not depend on anyone but yourself.  

    I oppose AB 131. I cannot support it. My grandmother didn’t waste her breathe telling me everyday of my life not to depend on the government. You want an education, then pay for it! Apply for citizenship, it’s not impossible. It’s hard but nothing in life should come easy. It wasn’t easy for my grandmother, raising three kids, and 4 grandchildren, putting one of her sons through college. She did it all cooked, cleaned, and paid her taxes and took nothing in return. That is what makes you American, coming to this beautiful country to make something of yourself and if not you then your children but you work hard and you do it yourself.
