What the California Dream Act’s AB 130 does – and doesn’t do

Although his staff hasn’t come right out and said it, Gov. Jerry Brown is expected to sign part of a legislative package referred to as the California Dream Act today. Immigrant advocates expect the governor to sign legislation referred to as AB 130, recently approved in the state Senate, during a town hall meeting that Brown will attend this afternoon at Los Angeles City College. The meeting is hosted by Democratic Assembly member Gil Cedillo, who sponsored AB 130 and a companion bill.

If Brown signs the bill, it will be a victory for the state’s undocumented college students, long barred from most forms of financial aid at public colleges and universities. To some degree, it’s a symbolic one: Unlike its companion AB 131, which would allow them access to the same public financial aid U.S. citizens and legal residents are entitled to, AB 130 only allows these students access to privately funded scholarships.

Still, it’s access to funds not previously available to undocumented students who qualify for in-state tuition under California law. According to a Los Angeles Times editorial today, the University of California awarded more than $45 million last year in donor-funded scholarships to undergraduates. But advocates are holding out for what they consider the real meat and potatoes, the more contentious AB 131, which has yet to make it to the Senate floor.

Student advocate Nancy Meza, a recent UCLA graduate who was brought here by her parents as a child and remains undocumented, sent out this message from a student group today:

Undocumented students are thankful that AB130 will be enacted into law; however, the more substantial portion of the CA Dream Act, AB131, needs to be taken out of Suspense in the Appropriations Committee and signed into law in order to have a true CA Dream Act.

AB131 will have the greater impact for undocumented students in their educational journeys as it would provide state financial aid to undocumented students. Currently, undocumented students are not eligible for any state or federal financial aid making financing their education nearly impossible.

The other bill faces an uphill climb because it would employ state funds, and with the state in a financial crisis, there is particularly strong opposition. Republican state Assembly member Jim Silva recently wrote in the Orange County Register:

AB131 would give illegal immigrants access to that aid, even though they legally cannot obtain a job in the United States after graduation. It makes no sense.

There is a pending federal proposal, the Development, Relief and Education for Alien Minors (DREAM) Act, that would grant conditional legal status to qualifying undocumented youths brought here before age 16 if they go to college or enlist in the military. Unlike the similarly named federal bill, neither of the two bills comprising the California Dream Act proposes legalization.

That the slimmer portion of the state package has made it this far is in itself a milestone. Cedillo, of Los Angeles, has brought forward similar legislation for years that has won the approval of legislative peers, but been vetoed by the governor’s office.

    This is a common misconception. There may be private
    scholarships/grants involved, but AB 130 also includes Board of
    Governors (BOG) Fee Waiver, and Institutional Student Aid: Student aid
    program administered by the attending college or university (i.e. State
    University Grant, UC Grant).

    Grants and Transfer Entitlement Cal Grants are unlimited and available
    to all students meeting financial need, GPA, and other eligibility
    criteria. Therefore, if passed, Dream Act students will be able to
    receive these awards if they meet the same requirements.Conversely,
    the number of Competitive Cal Grants is limited. However, the bill
    stipulates that Dream Act students may only receive one of these awards
    provided funds remain after all eligible non-AB 540 California residents
    are awarded. Since approximately only 1 in 10 eligible applicants
    currently receive a Competitive Cal Grant, it is likely that there will
    be no fiscal impact to the State with respect to this particular
    program.”So, where is this money supposed to come from?

    So they qualify for “in-state” tuition, even if they had to sneak to get in-state? Have we lost our minds? By what theory, legal. moral,  or otherwise, should we afford the rights of citizenship to those who snuck into our country uninvited? I honestly think we’ve simply gone stupid as a society.

    I am now voting Republican on every issue and candidate so that this can be repealed and deportations en masse may start.  We have allowed ourselves to be inundated with ILLEGAL ALIENS who take our jobs, ruined our education system by catering to them, and now, have pushed out LEGAL IMMIGRANTS and US CITIZENS from receiving their entitled share of these monies.  If AB 131 passes and gets signed, I fear that many people will not wait until the next election to rectify this self-hatred californians seem to have for themselves and their own children.

    I’m disgusted. While I am a firm advocate of education, if these students cannot obtain legal employment, then they will not be required to add to the tax base in our state, nor will they be required to pay taxes to the IRS. We pay taxes so that we can live in a safe society. I have absolutely ZERO sympathy for these students, or their families. Once these people reach their majority at age 18, they are welcome to take advantage of the legal system, and if they know American history from being educated and might I add fed (through welfare that they received for free because their parents don’t pay into the tax base either, and are likely living at or below the poverty level-the “better life” they wanted for themselves and their children by coming here in the first place) they can go and take the oath to become a legal American.While they may not be at fault for arriving here, as it was their parents’ decision, then those children who grow up here should take the necessary steps to remain here legally, and then begin paying back what they were given- a free and appropriate education K-12.  THEN and ONLY then should they be allowed to have access to monies that were earned and donated BY AMERICANS FOR AMERICANS to attend college. As a causasian person in the ”majority” I was denied many ascholarship because I am not a minority. This law is unfair and unconstitutional.

    There is no way for undocumented students to become legal citizens. A person who came to this country on a visa can get married and become a legal permanent resident but for those who were brought through without a visa there is no path to become a legal citizen. I doubt very much that you were denied a scholarship due to you not being a minority…maybe you should be more active in underserved communities or earned a higher grade point average. Please direct your anger at our politicians who refuse to tax families making more than 250k a year. If your family lies in this tax bracket, then you never needed the scholarship money in the first place!

    California is offically Mexifornia, so now american children have to compete with these foreign invaders for tuition costs. These Children are not to blame!! Only there criminal parents are who brought them here did not do any favors for them. Schools, State Governments spend millions of our tax dollars on printing books and pamphlets in spanish and not english.. When i go to mexico, nobody there speaks english to me. I need to conform to there lifestyle and culture as a guest. Here in California its all handouts. No requirements for them to learn english and assimilate to american culture and customs. Enough is Enough. If you follow the law of the land and enter this country legally, then welcome. I do not support Criminal behavior nor would i be treated nicely if I hopped the border to enter mexico illegally. Common Sense Folks!

    Your mention of Blacks, 70 years ago or a black president today, doesn’t apply here.  Those Blacks were BORN in the US, not immigrants in any sense.  And the Constitution REQUIRES a President to be Born in the US.

    Wow your stupid. If your going to speak publicly please check your facts. In the state of  California there are THOUSANDS of undocumented people paying taxes, and they DO pay taxes. Because unlike you, they don’t get all types of deductions and credits and so therefore they don’t get any refunds, they always have to pay. Unlike most other Americans who not only do not PAY any taxes but rather receive a refund. The fact that someones does not have a SSN doesn’t mean they’re not required to file taxes. Second checks your stats again, most people on welfare are neither Hispanics nor undocumented people. Much less college students. 
    Although I agree with you, people should strive to better their legal situation, they shouldn’t remain  here illegally. If they are good members of the community contributing to the economy I think they best alternative is to help them legalize. I am even OK with the govt. giving them small manageable fines for breaking the law. But i don’t believe they need to pay ANYTHING back, since, and trust me, they can’t really take anything they don’t really deserve, for the most part. And lets remember, we’re talking about students who want to better themselves, not cheat the govt. And I think its ridiculous to give some people $$ cover their tuition, books, fees, and on top of that give them ‘spending’ $$ while other students get nothing, simply because of their legal status. Lastly I was lucky to be born here with Mexican parents, the double nationality is great, but there are more than enough scholarships and grants out there for everybody, and they reason your not getting them is not because your not a minority. The reason your not getting them is because your obviously an idiot, who doesn’t deserve the $$ since your not smart enough to even do some research much less analyze a situation.

    It isn’t polite to call someone stupid.  Be nice, just because someone writes something you don’t like or agree with doesn’t mean you call them stupid.  I KNOW your mother taught you better.   Help me understand, why or how an illegal alien would pay taxes?  If they don’t have a SSN, how would they file or submit a return.  Also, if someone isn’t getting a refund and they are illegal, why would they file.  Remember, I am not stupid, I am just trying to understand.  If they are good members of the community, why aren’t taking the time to become US  citizens.  Lastly, you were born in the US.  Your nationality is American.  Claim it sweetie.  Your culture, and it is rich, is Mexican or Chicano.

    You are right. I do apologize for being rude. I will admit the only thing that got me heated was the fact that sometimes unfortunately sometimes WE make statements without any kinda of backing and often times their wrong. But I am sorry Jennifer Luchsinger for the name calling.
    JSB It is in many ways very beneficial for undocumented people to pay 
    taxes. Many of them only do it because they want to ‘be ok with the 
    govt’. Others do it because they are in the process of obtaining legal 
    papers, however this process can be very lengthy. For example, it took
    some of my family members 15+ years in order to get their residency. 
    Other people do taxes because they are required to. They can be 
    working with illegal papers and receive W-2 which that they have to 
    report. Others receive a form calle 1099 which is the form some 
    people receive when they get paid cash. Another reason to pay taxes
    is to get a ITIN number (individual taxpayer identification number)
    which is what they use to file taxes they way you would use your ssn. 
    With this ITIN people can get bank accnts and do other small stuff like 
    buying houses or starting a business. Of course laws change very often
    I not sure you can buy a house with an ITIN anymore, but 5+ years ago
    you still could. With an ITIN number students can apply to go to college 
    and fall within the boundaries of the AB540 which allows non-resident 
    CA students to pay in-state tuition rather than out of state.

    The IRS does not care about citizenship, they care about collecting taxes.  Undocumented workers are as afraid of the IRS as most citizens.  If they don’t have a valid social security number they apply for a tax number and pay their taxes.  Another thing is that everyone who works has to have social security withheld and the employer has to contribute an equal amount.  Undocumented workers using false papers pay social security but will never be able to receive benefits.  If you think social security is broke now, how would it be without the millions who pay but can never receive.  Grandpa is not only eating cheap food because they picked it but they’re paying for it too.

    I don’t recall saying I hated anyone, do you? The question at hand is whether they should enjoy the rights of citizenship when they are in fact, not citizens. If you wish to take someone to task, then “hate on” their parents, who snuck them in knowing full well, that doing so did not automatically grant them the full rights of citizenship.

    Why are some people in the comment section acting live all native born citizens deserve these rights? I’m from the mid-west and I went to very white washed college and let me tell you when you see a girl who get’s all the opportunity in the world to do what she wants and squanders it and gets kicked out of college because she can’t stop drinking and smoking pot long enough to take a test and then you see an illegal immigrant working there butt off studying to be better and not able to do anything past what the law lets them then that’s just sad. What ever happened to the pursuit of happiness all of us as individuals are in charge of our own destiny I think that these illegal immigrants brought here as children deserve a chance to at least become legal and become a part of society and try to improve it.

You too, can learn to be polite.  Did your mother and father didn’t teach you that?  If they did not then I completely understand your limited response.  Let me ask you this? Can you have a conversation with someone that doesn’t hold the same views as you without calling them names?  If you feel that I was being condescending “ass” as you say, well that is your issue in feeling shall I say inferior?   In regards to my response to Carlos, who clearly understood what I was asking and was quick to recognize that he was not being polite, was man enough to admit it. (Thanks Carlos for your response, BTW.  It was very informative. I found it helpful when discussing this with friends.)
    Chicana, I am trying to understand the situation rather than passing judgment which you have done.  So thanks for proving a point about how a few (not all) in the Chicano population are not willing to “be quick to listen and slow to open their mouth.” Oh I am sorry, you said European. 
    And to answer your question if you state that you are European, I DON’T think that the definition is limited to those that are British.  I understand that there are other countries in Europe.   
    In the history books of the US, which I could go into long diatribe but not going to, the US didn’t steal.  Okay maybe we did, but it was a war and men are mean, but it was a long time ago, and all the people that were living in those territories became citizens.  So stop crying. You sound as ignorant as those in the South who are still upset over the outcome Civil War, or “The War of Northern Aggression”.     Okay, that was mean, sorry.
    Lastly, if there are people who are here ILLEGALLY are those that have crossed the US Border illegally.  (Whether it is the Northern Border -that’s Canada in case you are confused, flew over from Asia, or your beloved Europe, or even from the South.  It is considered Illegal Immigration.  That is how the United States government calls it.  You can sugar coat it all you want, that is what it is. 
    I can tell that this topic burns you up as I read some of your replies below.  But remember the best way to get someone to understand your point, is to not insult them but try to understand their point of view.  Maybe they will try to understand yours.

As an illegal immigrant which whom the Dream act would apply to I have grown up here since I was three and have realized many things. I have applied for my green card and have been waiting for 11 years now and still have gotten no news about my place in line. What mainly boggles my mind is how you ignorant americans and politicians expect us illegals waiting for our green card to live if we can’t legally work, drive, or live meanwhile being forced to wait for decades for this damned card? I love america but how does that make any sense? I am forced to live illegally while i wait for to turn while you people call us dirty names and give us a look. How can i live here which i call my home now have been for 20 yrs. Comfortably? I cant wait for the day when i get it so i can finally enjoy the things and activities that you americans take for granted. The basic necessities to live.     This is exactly what Pres. Obama wants, he wants more states to pass the Dream Act so it will become nationwide, thus the Dream Act. One must ask, where does this so called “private” funding receive their funds? They receive Government grants,which ultimately come from our pocket book in the form of taxes.

    The Dream Act is not a dream but a nightmare. There is NOT one country on this earth except this country that rolls out the red carpet and gives free education to illegals. This act is beyond stupidity. Gov. Brown approved the state version, but is welling to cut care for American citizens and the elderly just so that illegals can obtain education. What the HELL happened to providing for AMERICAN CITIZENS??? Has this country gone crazy?

    I just read most of what everyone wrote. One thing that I see most often is “Illegals pay taxes.” If an Illegal is in this country paying taxes on wages earned, then something is very wrong. It means they have a fake social security card number period!

    The only tax they are paying is when they purchase goods and services. I really want someone to come forward with hard proof of how they pay taxes other then for the goods and services they purchase. I like everyone else pay property taxes, wage tax, and taxes for goods and services.

    They steal people’s identity..It happened to me and they filed taxes using my social security number…Someone from my highschool in Los Angeles must have been selling the social security numbers.  The IRS contacted me and I eventually resolved the matter.   I hope someone was deported as a result because a crime called identity theft was commited against me..

    Most US citizens are well aware of the bureaucracy of the US government we are not ignorant to that.  Let me ask you this, what about those that are currently waiting in line from the country that they were born in for a green card?  I have a friend who is from Italy and is still waiting after a long period of time.  Do you feel that you should be allowed to get in front of those who have waited in front of you? What about those people who have done it legally and are awaiting a response?  Is it fair to push their green card applications aside?  It is as if you are stating because you are here you should have your application viewed or approved of first?  What happens if you are not approved?  Do you just stay here illegally?    Let’s say for example that the Dream Act is possible.  What do you suggest that the government do?  Come up with a compromise that would be suitable for all that is involved not just one side.

    Excuse me, but how can an American take advantage of academic institutions when now some of the financial aid our kids are too get are being turned down and given to illegal kids. We pay taxes all our lives and my daughter lost her job, no unemployment and filed for financial aid and got denied. Well, let’s see how many illegals get it. Also my friends daughter applied last month because she lost her job and no income coming in and got turned down. Isn’t it funny that the Dream Act just got signed by our stupid Governor and true Americans are getting turned down to have money for illegals. This is why California is in so much debt because of all the free programs illegals take advantage of. ILLEGAL is just that. If we did something illegal we would be in jail. But I guess you don’t care where your tax dollars go.

I am 21 and have lived here “uninvitedly” for 16 years. We came here for a better life and that’s what we got. I attend college and don’t pay a cent. My father makes more than 200,000 a year and still gets tax refunds. We have four cars and are buying our first home, i would say we are doing better than most of you citizens. Why? Because since we are not legal, you can’t control us with your laws, we don’t exist. So until we get deported we will continue as we are. So keep up the stupidity America. =D

    “the education system remains the same”??? what??? are you being serious?  Studies show that, in the state of California, the education system has been deteriorating slowly since the 1950′s.  Schools are dumbing down it’s students, and with many students who only speak Spanish and classes that are slowed down in order to accomodate the Spanish speakers, yes.. our education system has taken a HUGE hit due to the influx of illegal immigrants.  To believe differently is ignorant and naive.

    HOW UNFORTUNATE that the author of this article didn’t do any research on the federal DREAM Act and/or is misleading her readers. The DREAM Act does NOT require enlistment in the “military.” The bill specifically allows for work in the “uniformed services” which, as the bill’s authors fully understand, does not include only military service. Work at the Oceanic and Atmospheric Administration would qualify.

    Furthermore, this journalist/activist doesn’t want you to know that there is NO requirement that Dream Act recipients actually graduate from college. As written, the bill would allow an illegal alien to attend college for two years, and then drop out… and that would be sufficient to acquire U.S. citizenship.

    The media loves to spread lie after lie after lie. And they wonder why people hate them.

    This Dream Act is so stupid. For those illegal immigrant that posted here, “YOU SHOULD BE ASHAMED OF YOURSELF”. Any supporter of this Dream Act should be ashamed of yourself. I’m an immigrant myself. (LEGALLY) I wanted a better life that’s why I came to the US. I’ve been here for over 10 years and not yet get my green card, but will get it soon through the company I work for. All this time that I’ve been in the US, I paid a lot of money to keep my status as LEGAL IMMIGRANT. USA provided a lot of means for you to come here legally, and if you were brought here illegally there are ways to change that to LEGAL. You just have to work hard to find the best solution for your situation. If there is no possible way for you to obtain your legal status, and if education is so important to you then save up your illegally earned money and go to college. You already got free education all the way to 12th grade, and the cheap in-state tuition fee.(Compare to $300+ per unit that legal international student have to pay) What more do you want? 
    From where I came from, we ask the owner of the house for a permission to enter their home. If they said ‘yes’ then we can enter. If they set rules for us to follow while we are in their home, we follow. We will not take anything that belongs to the owner or his family. 
    We call those people who sneak into other people’s home uninvited and take away owner’s belongings ‘THIEF’. 
    May be this Dream Act should be called Thief Act.

    i just wanna say that i was born here but my parents took me to their country so could speak Spanish, anyways when i came back i had friends 5 of them were us citizens, one undocumented, and one with visa. the undocumented one had a GPA of 4.0 amazing! the one with visa had a GPA of 3.5, one citizen had a GPA of 2.5 the rest had it like 1.3 or less, and they consume drugs, alcohol, etc. so basically Mexico and other countries aren’t the ones to blame for the drugs and stuff, people here are the ones consuming that stuff, and prove me wrong, but some people here in this country intentionally brought this people here by buying drugs to Others countries, witch give the cartel money and power to kill, slave any person, etc………. so before saying something make sure you know what u talking about :) have a nice day

Most “illegals” work their asses off cleaning restroooms sometimes even wiping off shit from the toilets sometthing that people can do by themselves, doing “rich” peoples front yards or gardens in the blazing heat sometimes, pick up trash, clean their houses, and americans say they are stealing their jobs???     CA FAFSA (the financial aid application) is due in March. So seeing as you posted in October you friend who applied last month missed the actual deadline by about 6 months. This is probably why (if these folks actually exist) they did not receive financial aid.

Im 17 and i got smuggled here without knowing i was and immigrant, i just cant go back to Mexico because of how many people are being killed. Second of all my family pays taxes that goes toward financial aid for your American children. Thirdly the Dream Act has not been signed the only bill signed by our governor is that for PRIVATE funds NOT government or state funds. If the citizens of California are funding the education of illegal aliens (excuse me, undocumented students), are the countries in which they are citizens reciprocating by extending education funding to California citizens? I have no issue with Governor Brown or others who choose to fund undocumented students with their own personal funds, if that’s their desire. I take exception when they choose to use my personal funds.

I am a citizen, I have to submit to all kinds of laws which I do not believe are fair to me and my family, but I do because this is my country. American  citizens and legal immigrants should go ahead of the illegals who are here trying to get money for school;  and it should not be coming from the American and Legal immigrant taxpayers to fund these students.  If you have chosen to live in this country, then respect it, its laws, and its language and learn how to be a part of this dream.     Financial assistance in higher education should be given to those who DESERVE it, regardless of legal status. I would much rather my tax money go to an undocumented student who is taking challenging course, getting a 4.0 GPA, and receiving high test scores than an American citizen who is barely making it by with a 2.0 and won’t do jack to change it. My college education wasn’t paid for because I belong to a minority group; it was paid for because I worked my butt off in high school.

    AB13l is coming out of our pockets.  It was passed when we are experiencing our own financial hardships, a Holiday Weekend and Marches going on through out the U.S.  It is being done in increments but now it is coming out of the Citizens of California pockets.  How will we prove the income of Illegals if they work under the table?  How can we verify the true age of the person applying for the Education if we can not ask them?  The parents however must pay rent or are buying a home, paying for Utilities, Cable ect., and if they can have these services they must be making some monies and it should be pursued.   If next the Governor pursues Amnesty, the Citizens of California should be informed ahead of time so that we can voice our opinions.

    If their parents are responsible adults they would have applied for citizenship and made sure their children had also.  Then you would know they want to be here and become citizens in the right way and above all that their children do so, so that they will have all the benefits of an American citizen.  We provide that path, we provide free Engilsh classes for parents, we provide free public school education for their children and provide health care to them when needed.  They can receive discounted utility bills, the WIC program, mental health, HUD, but when the Governor starts pushing for more and more we have a right to question his motives.

    i apologize but i am  hispanic myself and actually don’t wish the dream act passes, so dont include everyone as a whole, cus many hispanics as well as legal imigrants are con ! why cnt we use these 40 million dollars anually for more things like OUR social security or for elderly people? this is just a bigger strain for our California budget as well as OUR education.     Amen, Betsy! I don’t know you, but I would love to. The Dream Act is just that..an answer to the American Dream. To think that my grandparents on both sides came to America without papers (thus the nasty nicknames given back in the day) and went through the naturalization process to become American citizens.  Because things have gotten so out of hand and the American Dream has been long forgotten, people who live here and are living the so called American Dream, don’t want to share it with anyone else. These children are as entitled to be here as my parents were, when their parents brought them here. I wouldn’t be living the American Dream if not for them! Pass the Dream Act and give all that want to work, be educated and pay taxes, a chance to do just that.

    I can answer this question for you. The people these posts are referring to are people who came over with a valid I-94 and were issued a visa by Immigration. With that visa, they were able to secure an ITIN (in lieu of a SSN) that allows them to work in the US. They are REQUIRED to file a 1040 income tax return at the end of the year, just like any other employee, because they are paying taxes..just like any other employee. The only difference on their tax return is that if they are married and all dependants have ITIN’S, they are NOT entitled to EIC. They only get what they earned. The law is set up that way. There is no need to panic, that the people who are coming here to make a better life, are getting any more than they are working for. They cannot get medical benefits without a SSN, neither food stamps. All this ranting is just hateful and unneccessary. I’m happy that Social Security is being built up for us. Remember, without a valid SSN, you cannot draw benefits. It isn’t fair to the people working and paying the taxes, but they are earning much better wages than where they came from. However, we the US citizens will be the beneficiaries of their spoils. Hope this helps.
